General Terms and Conditions

1. GENERAL

The general terms and conditions of online shopping are drawn up in accordance with the Consumer Protection Act (ZVPot), the Consumer Protection Against Unfair Business Practices Act (ZVPNPP), based on the recommendations of the Chamber of Commerce of Slovenia and international codes for online and electronic business. The online store Relive Shop (hereinafter referred to as the "online store") is managed by the company Gemis, d.o.o., Cesta privi borcev 11, 8250 Brežice, PE Relive, Lenartova pot 28, 8250 Brežice. (hereinafter referred to as the "provider"). These General Terms and Conditions define the operation of the online store, the rights and obligations of the visitor, user and buyer, as well as the business relationship between the provider and the user as a buyer of products from the online store.

2. METHODS OF PAYMENT

When shopping online, the provider offers the following payment methods:

  • cash on delivery (upon receipt of goods);
  • payment by advance invoice by bank transfer to a business account;
  • payment via Pay Pal and credit cards.

The provider issues an invoice on a permanent medium (paper) with a clear breakdown of the costs. The notice to the buyer about the possibility of withdrawing from the contract and the procedure for returning the goods are covered in the General Terms and Conditions.

We recommend that you print and save the general business conditions.

3. VALIDITY OF THE OFFER

Prices are subject to change without prior notice. When purchasing, the prices apply at the moment of order confirmation.

4. PRICES

All prices are expressed in euros (€) and include VAT. Prices do not include delivery costs. All prices are valid at the time of placing the order and do not have a predetermined validity, so they are valid only until they are changed each time.

5. PAYMENT OF POSTAGE

5.1 SUPPLIER

Postage is covered by the buyer when the order amount is less than €50. The amount of postage depends on the choice of delivery.

6. PURCHASE PROCEDURE

6.1. TECHNICAL STEPS LEADING TO THE CONCLUSION OF A SALES AGREEMENT

The following technical steps are available to the user (buyer) during the purchase process:

  • login to the online store using an email address, it is also possible to log in with a Facebook and Google account,
  • searching for an individual product in the product range in the online store, product selection for purchase,
  • adding the selected product for purchase to the shopping cart,
  • determining the quantity of the product to be purchased in the shopping basket, review of the price of the selected product in the selected quantity, including the calculated tax,
  • selection of product delivery method (see also point 5.),
  • selection of payment method (see also point 2.),
  • review of the order with the selected method of delivery of the product and the calculated delivery costs, if these are calculated, and
  • confirmation and submission of the order, thereby completing the purchase (see also points 6.3 and 6.4).

6.2. TECHNOLOGICAL MEANS THAT ENABLE THE IDENTIFICATION AND CORRECTION OF ERRORS BEFORE SUBMISSION OF THE ORDER

Before submitting the order, the user (buyer) is enabled to:

  • he sees which products he has selected and added to the basket,
  • see the price of an individual product and the total price of the entire selected quantity of an individual product,
  • changes the selected quantity of an individual product and calculates the new amount of the thus changed quantity,
  • removes the selected products that he does not want to buy from the basket and calculates the corresponding tax, according to the tax rate applicable to the selected product and its price (tax basis).
  • Before confirming the order, the user (buyer) can change the method of delivery and the method of payment.

6.3. ORDER ACCEPTED

After placing the order, the user (buyer) receives a notification by e-mail from the provider that the order has been accepted. Within 1 hour of receiving this notification, the user (buyer) has the option to cancel the order. Except for the possibility of cancellation, the user (buyer) cannot change the content of the order after placing the order. The user (buyer) can always access detailed information about the status and content of the individual order in his profile on the provider's website.

6.4. GOODS SHIPPED

The provider prepares and ships the ordered products within the agreed period and informs the user (buyer) about this by e-mail.

7. METHOD AND DEADLINE OF DELIVERY

The provider undertakes to ship the ordered products as quickly as possible. Most orders received on a working day by 10:00 a.m. are shipped the same day or within 2 working days at the latest. In the event that a certain product is not in stock and the delivery will take longer than 2 working days, we will notify you immediately by phone or e-mail. Once again, for the sake of such notifications, we ask you to enter accurate information when logging into the system.

The products are delivered by a contracted delivery person. If you want to choose a different delivery date, please inform us by phone on 051 334 145, e-mail: splet@relives.si, or enter a comment before placing the order.

8. YOUR ORDER (CONCLUDED CONTRACT)

We keep your order in our computerized records of received orders. You can inspect your order at the business premises of Gemis, d.o.o., PE Relive, located at Lenartova poti 28 in Brežice. We are available from Monday to Friday between 9:00 a.m. and 5:00 p.m.

The provider, in cooperation with the contracted delivery man, distributes the ordered goods only within the EU. The contract can be concluded in Slovenian or English.

9. RIGHT TO PRIVACY

The provider undertakes to permanently protect all personal data against loss, misuse or unauthorized access in accordance with the Personal Data Protection Act (ZVPot). The data will only be used for communication with the user. Based on your consent, we will use your personal data exclusively for sending informational material, offers, invoices and communicating with you - marketing and informing you of news through various means of communication. Under no circumstances will the user's data be passed on to a third party.

10. SECURITY

The provider uses appropriate technological and organizational means to protect the transfer and storage of personal data and payments. For these purposes, the merchant uses a 128-bit SSL certificate issued by an authorized organization.

The user himself is also responsible for security, namely by ensuring the security of his username and password, as well as the appropriate software and anti-virus protection of his computer.

11. CARE OF CHILDREN

The provider in the online store does not accept orders from someone he knows or suspects to be a child without the express permission of his parents or guardians. The provider in the online store does not offer free access to products or services that are harmful to children.

Without the express permission of parents or guardians, the provider will not accept any personal data concerning children, nor will it release data received from children to third parties, except parents or guardians.

Any communication aimed at children will be age-appropriate and will not take advantage of children's trustworthiness, lack of experience or sense of loyalty.

12. DISCLAIMER

The provider regularly ensures that the information published on its pages is up-to-date and correct, but product features, availability and price can change so quickly that the provider fails to correct the information on the web pages. In such a case, the provider will inform the customer about the changes and enable him to cancel the order or replace the ordered product.

Product photos in most cases show the authentic appearance of the product, however, they can sometimes be purely symbolic and do not necessarily guarantee the product's characteristics.

From the moment the shipment with the ordered products is handed over to the delivery person, the provider is not responsible for cases of physical damage, destruction or loss of the shipment, as well as if the contents of the shipment are missing or if the shipment shows signs of being opened. In the above cases, the user (buyer) must initiate a complaint procedure with the delivery person.

The provider reserves the right to change the terms of business at any time and in any way, regardless of the reason and without prior warning.

13. COMPLAINTS AND DISPUTES

The provider complies with the applicable legislation and regulations in the field of consumer protection. Users can send objections, comments, requests and statements by e-mail to info@reliveshop.si or by regular mail to the address Gemis, d.o.o. PE Relive, Lenartova pot 28, 8250 Brežice. The review process is confidential.

The provider undertakes to confirm to the buyer within 5 working days at the latest that he has received the complaint and to inform him how long he will process it and to keep him informed throughout the process. The provider makes every effort to resolve any disputes amicably. If an amicable solution to the dispute is not reached, the court of actual jurisdiction in Brežice has exclusive local jurisdiction to resolve all disputes between the provider and the user (buyer). The provider and the user (buyer), as participants in electronic business, mutually recognize the validity of electronic messages in court.

For these General Terms and Conditions and for all disputes between the provider and the user (buyer), Slovenian material and procedural law applies and is applied, whereby the rules of international private law that would prove the application of any other law do not apply.

The provisions of the Code of Obligations, the Act on Electronic Business on the Market, the Act on the Protection of Personal Data and the Act on Consumer Protection apply mutatis mutandis to all relationships and rights and obligations not regulated by these General Terms and Conditions.
